Terms of Service
1 Acceptance of Terms
These Terms of Service ("Terms") govern your use of Truvo Pulse, a competitive intelligence platform operated by Truvo Analytics ("we," "us," or "our") at console.truvo.org.
By creating an account, accessing, or using Truvo Pulse, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the service.
If you are using Truvo Pulse on behalf of a business, you represent that you have authority to bind that business to these Terms.
2 Description of Service
Truvo Pulse is a competitive intelligence platform for small businesses. We use publicly available data from the Google Places API to identify nearby competitors, score and rank them by threat level, and surface actionable market intelligence through a web dashboard.
Features include:
- Live competitor tracking — ratings, review counts, distances, and threat scores
- Interactive market map with competitor locations
- AI-generated competitive opportunities powered by Anthropic Claude
- Weekly email digests summarizing market changes
- Review sentiment analysis and alert notifications
- Pro tier features: benchmarks, demand forecasting, and price tracking (when available)
All competitor data is sourced from publicly available information via the Google Places API. We do not access private, confidential, or proprietary business information.
3 Account Registration
- Accurate information: You must provide accurate, current, and complete information when creating your account. Do not impersonate another person or misrepresent your affiliation with any business.
- Business verification: To use Truvo Pulse, you must verify ownership or management authority over your business by receiving an SMS verification code at the phone number listed on your Google Business profile. This is required to ensure data integrity and prevent fraudulent accounts.
- One account per business: Each business may have one active Truvo Pulse account. Creating duplicate accounts for the same business location is not permitted.
- Account security: You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at contact@truvo.org if you suspect unauthorized access.
- Eligibility: You must be at least 18 years old and legally authorized to conduct business in your jurisdiction to create an account.
4 Acceptable Use
You agree to use Truvo Pulse only for lawful business intelligence purposes. The following uses are strictly prohibited:
- No redistribution: Do not scrape, download, export, redistribute, sell, sublicense, or commercially exploit the data, reports, or insights provided by Truvo Pulse
- No unauthorized accounts: Do not create accounts for businesses you do not own, operate, or have explicit authority to represent
- No automation: Do not use bots, scripts, crawlers, or other automated tools to access the service beyond normal browser use
- No interference: Do not attempt to probe, scan, or test the security of our systems, or attempt to gain unauthorized access to any part of the service
- No harmful use: Do not use Truvo Pulse to harass, defame, or harm any person or business
- No illegal activity: Do not use the service in any way that violates applicable laws or regulations
Violation of these restrictions may result in immediate account termination and, where applicable, legal action.
5 Data and Content
Competitor data
All competitor information displayed in Truvo Pulse — including business names, ratings, review counts, addresses, and geographic data — is sourced from the Google Places API and is publicly available. We aggregate, score, and present this data for informational purposes.
AI-generated insights
The competitive opportunities and insights generated by Truvo Pulse are produced by Anthropic's Claude AI and are provided for informational purposes only. They do not constitute financial, legal, operational, or professional advice. You should exercise your own judgment before making any business decisions based on AI-generated content.
We do not guarantee the accuracy, completeness, or timeliness of data obtained from third-party sources including Google Places. Ratings, review counts, and business status may differ from real-time reality. Use this data as one input among many — not as a sole basis for business decisions.
Your business data
You retain full ownership of the information you provide about your own business. We do not claim any intellectual property rights over your business data. We use it solely to provide and improve the Truvo Pulse service.
6 Pricing and Payments
- Free tier: Basic competitive intelligence features are available at no charge, including the market map, competitor tracking, and weekly alerts
- Pro tier: Advanced features (benchmarks, demand forecasting, price tracking) are available at the pricing posted at the time of purchase. Current pricing is $79/month.
- Payment processing: Pro tier subscriptions are processed via Stripe. By subscribing, you agree to Stripe's Terms of Service in addition to these Terms.
- Billing: Subscriptions are billed monthly. Your subscription renews automatically until you cancel.
- Cancellation: You may cancel your Pro subscription at any time via account settings. Your access continues until the end of the current billing period.
- Refund policy: Monthly subscription fees are non-refundable. If you have a billing dispute, contact us at contact@truvo.org and we will work to resolve it in good faith.
- Price changes: We will provide at least 30 days' notice before increasing subscription prices.
7 Intellectual Property
Our property
Truvo Pulse, the Truvo Analytics name and logo, the dashboard design, the threat scoring algorithm, the market intelligence methodology, and all associated software, code, and content are the exclusive property of Truvo Analytics and are protected by applicable intellectual property laws.
Nothing in these Terms grants you any right to use our trademarks, service marks, trade names, or logos without our prior written consent.
Your property
You retain full ownership of your business data and any content you submit to Truvo Pulse. By submitting this data, you grant us a limited, non-exclusive license to use it solely for the purpose of providing you with the Truvo Pulse service.
8 Limitation of Liability
Service provided "as is"
Truvo Pulse is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or completely secure.
No liability for business decisions
We are not responsible or liable for any business decisions, losses, or damages arising from your use of or reliance on information, data, or AI-generated insights provided by Truvo Pulse. You are solely responsible for how you apply this information to your business.
To the maximum extent permitted by applicable law, Truvo Analytics' total liability to you for any claims arising from or related to these Terms or your use of Truvo Pulse shall not exceed the total amount you paid us in the 12 months preceding the claim.
Exclusion of consequential damages
In no event shall Truvo Analytics be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, or business opportunity, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.
9 Termination
- Your right to terminate: You may delete your account at any time through account settings or by contacting us at contact@truvo.org. Upon deletion, we will remove your personal data within 30 days.
- Our right to suspend or terminate: We reserve the right to suspend, restrict, or terminate your account at our sole discretion if we determine that you have violated these Terms, engaged in fraudulent activity, or posed a risk to other users or our service. We will provide notice where reasonably possible.
- Effect of termination: Upon termination, your right to access the service immediately ends. We will retain data only as required by law or for legitimate business purposes, and will delete your personal data within 30 days of account closure.
- Survival: Sections 5 (Data and Content — intellectual property), 7 (Intellectual Property), 8 (Limitation of Liability), and 10 (Governing Law) survive termination of these Terms.
10 Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or your use of Truvo Pulse shall be subject to the exclusive jurisdiction of the state and federal courts located in Dauphin County, Pennsylvania. You consent to personal jurisdiction in these courts.
Before filing any formal legal claim, you agree to first contact us at contact@truvo.org and attempt to resolve the dispute informally for at least 30 days.
11 Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, applicable law, or business practices. When we make material changes, we will:
- Update the "Effective date" at the top of this page
- Send an email notification to your registered address at least 14 days before the changes take effect
Your continued use of Truvo Pulse after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the service and delete your account before the effective date.
